摘  要:在现代人眼里,法律与诗歌似乎处于对立的两极,但揆诸历史,即发现,上述理念存在较大偏差。因为:在古代,诗法同源,几乎所有民族或国家早期的法律都是严肃、认真的诗,一些伟大的诗人被奉为“未被承认的立法者”;近代和现代早期,很多诗人是从法学院逃逸出去的学生,以至法律一直是诗歌的重要主题。自从进入现代,随着社会分工的日益加剧,法律与诗歌开始疏离,这使得法律领域越来越缺乏审美情趣和人文关怀。为消除因拒斥诗歌而引起的弊端,应在法律领域为诗歌保留一席之地。虽说法律与诗歌的关系不为中国学者所重视,但它同样是中国法律史上的一个重要主题,并且,具有自己的特色。In modern perception, law and poetry seem to occupy opposing poles, but a closer examination of history reveals a signifi cant deviation from this notion. In ancient times, law and poetry shared a common origin, as nearly all early laws of nations or peoples were composed as solemn, serious poetry.Some great poets were even regarded as “unacknowledged legislators”. During the early modern period,many poets were students who escaped from law schools, making law an enduring theme in poetry. However,with the increasing specialization of modern society, law and poetry began to diverge, leading to a lack of aesthetic sensibility and humanistic care in the legal field. To address the drawbacks caused by rejecting poetry, a space should be reserved for poetry within the domain of law. Although the relationship between law and poetry has not been a focus of Chinese scholars, it remains an important topic in the history of Chinese law, with its own unique characteristics.
