摘　　要：本文聚焦科技成果转化尽职免责制度现状,探讨了推进医疗卫生机构构建和实施该制度路径。通过梳理科技成果转化尽职免责概念和研究分析相关政策文本,发现当前科技成果转化尽职免责政策文本对认定程序、结果运用、失职问责等规定不足,契合医疗卫生机构特点和需求的免责细则有待完善。建议夯实医疗卫生机构内部科技成果转化制度体系、依法依规建立本单位科技成果转化尽职免责制度,加强自上而下的制度建设指导,并注重加强信息披露公开和引入专业服务。This paper concentrates on the present state of technology transfer due diligence exemption system and investigates the approaches for medical and health institutions to establish and implement this system.The study reviews the concept of technology transfer due diligence exemption and analyzes policy texts at both national and local levels to identify existing issues.The findings reveal that the current policy texts concerning technology transfer due diligence exemption are deficient in terms of identification procedures,application of results,and accountability for dereliction of duty.There is a need to further develop detailed exemption rules that are consistent with the unique characteristics and requirements of medical and health institutions.It is recommended to reinforce the internal technology transfer system within medical and health institutions,establish a technology transfer due diligence exemption system in accordance with laws and regulations,enhance top-down guidance in system construction,and place emphasis on improving information disclosure as well as integrating professional services.
