摘 要:联合国安理会决议造法的实践揭示了国际法渊源的动态发展的趋势。联合国法律人格的派生性和独立性决定了安理会造法的政治动力和法律基础,进而影响其造法性决议在国际法的动态渊源体系中的效力起点和发展进路。安理会硬法创制和软法建构的双重叙事表明,安理会的造法性决议因决策程序的权威性和决议规范的实效性在实证法的逻辑下强化其法律约束力,同时也应通过主体和价值的开放在自然法的指引下寻求其实质正当性。安理会造法生动地演绎了大国政治与国际法治的对立和互动关系。作为安理会常任理事国和国际社会的负责任大国,中国应推动安理会造法的合法性和正当性之互动和同构,从而促进国际法规范实效的强化和价值的正义化。The practice of law-making by the UN Security Council reveals the dynamic development trend of the sources of international law.The derived and independent legal personality of the UN determines the political motivation and legal foundation of the Security Council's law-making,affecting the starting point and development of its normative resolutions within the dynamic framework of international law.The dual narrative of hard law creation and soft law construction indicates that the authoritative decision-making process of the Security Council and the effectiveness of its resolutions enhance their legal binding force under positive law logic,while also seeking substantive legitimacy through openness to subjects and values guided by natural law.The law-making of the Security Council vividly illustrates the opposition and interaction between great power politics and the rule of law in international relations.As a permanent member of the Security Council and a responsible big nation in the international community,China should promote the interaction and co-construction of legitimacy in the Security Council's law-making to strengthen the effectiveness of international legal norms and promote the justice of values.
