新时代能动司法意涵的理性解析

摘　　要：能动司法在我国提出10余年,至今社会各方面对此认识仍未统一,主要原因在于对能动司法的意涵缺少共识性的理解,而不同理解又进一步引致了对能动司法选择上的分歧。因此,新时代能动司法重新倡导的前提性任务或前置性条件在于理性地揭示这一范畴或概念的意涵。新时代能动司法的意涵应通过多个维度加以锚定:主体自觉意识、外部社会面向、法治基本边界、优良政法传统、司法发展趋势、主动创新思维、回应需求能力、实际效果导向等。新时代能动司法的倡导与实施直接关系到司法公正等司法理念的实现,关系到司法改革的深化以及司法长期稳定的发展,因而是法院工作中具有全局意义的重要抓手。在全力倡导建立中国自主法治理论体系、话语体系、知识体系的当下,能动司法应是这一体系建立过程中不可多得的科学范畴或概念,从而也是不应错失的宝贵理论资源、实践资源乃至政治资源。Proactive justice has been proposed in China for over a decade,yet a unified understanding of this proposal across various sectors remains elusive.This is primarily due to a lack of consensus on its implications,leading to differing views on its practical choices.Therefore,the foundational task of advocating for proactive justice in the new era is to rationally reveal the underlying meaning of this concept.The implications of proactive justice should be anchored through multiple dimensions:the awareness of the subject,external social orientation,the basic boundaries of the rule of law,fine traditions of political and legal governance,trends in judicial development,proactive innovative thinking,responsiveness to the social needs,and orientation towards practical outcomes.The advocacy and implementation of proactive justice are directly related to achieving judicial fairness and the deeper reform of the judiciary,thereby serving as a crucial instrument in the overall governance of courts.As efforts to establish an autonomous theoretical system of law,discourse system,and knowledge system with Chinese characteristics gain momentum,proactive justice emerges as a significant scientific judicial category or concept in this process,representing a valuable theoretical and practical resource.
