摘　　要：随着云计算、大数据、人工智能、区块链等网络技术迭代发展,大量的网络犯罪也层出不穷,网络犯罪分工日渐精细化,形成了上、中、下游相互协作的黑灰产业链。作为网络空间的新产物,其手段的多样性和技术的复杂性成为刑事治理的难题之一。对网络黑灰产业链的刑事规制应正确理解,把握新型网络犯罪的立法价值和政策导向,积极调整网络黑灰产活动的犯罪化立场,引入“规制主义”刑法新理念,规制主义刑法是对新时代网络犯罪刑法机能观的调整以及对传统刑法理念的重塑。刑法从事后的制裁转向事前的预防性规制,并通过司法解释适度扩张或限缩解释不断完善前置法,对新型网络黑灰产活动犯罪进行体系性、扩张性立法,明晰刑法适用的统一标准、建立层次化的制裁体系和多元化的制裁手段等,从而提出合理有效的网络黑灰产违法犯罪刑行衔接一体化的刑事规制路径。With the iterative development of network technologies such as cloud computing,big data,artificial intelligence,blockchain,etc.,a large number of cyber crimes are also emerging in an endless stream,and the division of labor of cyber crimes is becoming more and more refined,forming a black and gray industry chain of upstream,middle and downstream cooperation.As a new product of cyberspace,the diversity of its means and the complexity of technology have become one of the problems of criminal governance.The criminal regulation of the network black and gray industry chain should be correctly understood,grasp the legislative value and policy orientation of the new network crime,actively adjust the criminalization position of the network black and gray production activities,and introduce the new concept of“regulation”criminal law.The regulative criminal law is the adjustment of the functional view of the criminal law of cybercrime in the new era and the reshaping of the traditional criminal law concept.The sanctions after the criminal law is engaged in turn to the preventive regulation in advance,and the pre-law is constantly improved through the moderate expansion or limited interpretation of the judicial interpretation.Systematic and expansive legislation on the crime of new cyber black and gray production activities,clarify the unified standards for the application of criminal law,establish a hierarchical sanctions system and diversified sanctions,etc.,so as to propose a reasonable and effective criminal regulation path for the integration of cyber black and gray production crimes.
