大数据在检察案例指导制度中的适用路径研究

摘　　要：检察指导案例融合了监督功能和程序特性,在保障法律统一正确实施的过程中,与大数据形成了时代共生关系。大数据的数据监测技术、类案图谱功能,以及算法理性有助于检察指导案例的形成、识别和适用。与此同时,碎片化、冗余性的大数据信息,以及大数据关联性分析技术极有可能弱化指导案例的权威性、准确性,以及案例推理的逻辑因果性。大数据时代,为保障法治实践智能化与智能技术法治化,可以通过规范案例文本的数字化表达方式、完善案例的数字化协同公开机制、坚持法律方法引导大数据技术等举措,优化大数据在检察案例指导制度中的适用模式,从而增强检察案例指导制度的实施效果。The procuratorate guiding cases are designed to guarantee the unified and correct implementation of the law.They possess both supervisory attributes and procedural characteristics and have a symbiotic relationship with big data in the contemporary era.On one hand,big data monitoring promotes the formation of similar cases;the classification map ensures the typicality of similar cases;and the algorithmic rationality enhances the objectivity of applying similar cases.On the other hand,fragmented and redundant big data information,along with the big data correlation analysis technology,are highly likely to undermine the authority,accuracy,and causality of guiding cases,as well as the reasoning of case law.To ensure the intellectualization of legal practice and the legalization of intelligent technologies and to enhance the implementation effect of the procuratorate case guidance system,it is necessary to optimize the big data application path of the procuratorate case guidance system by standardizing the digital expression of case texts,improving the digital collaborative public disclosure mechanism,and insisting on guiding big data technologies through legal methods.
