摘　　要：【目的】目前审查工作中对于同样的发明创造的判断标准并不客观,为了避免审查员不当的质疑损害专利权人的合法利益,有必要对禁止重复授权原则进行探讨。【方法】在实质审查阶段引入司法视角,通过不同视角对同样的发明创造进行判断,重构对同样的发明创造判断的“三步法”。【结果】“三步法”的判断方法可以从根本上解决重复授权审查阶段的主观影响,避免审查员在站位本领域技术人员时导致的标准模糊问题。【结论】通过诚实信用原则的运用及对专利一并许可或转让的限制,可以避免“三步法”的缺陷,最终实现“禁止重复授权原则”的立法宗旨。[Purposes]The judgment standard for the same inventions-creations in patent examination is not objective at present.In order to avoid the examiner's improper questioning that may harm the legitimate interests of the patentee,the principle of prohibiting double patenting must be discussed.[Methods]This paper introduced a judicial perspective during the substantive examination stage,and reconstructed the objective"three-step method"for judging the same inventions-creations.[Findings]The method of judgment can fundamentally solve the subjective impact,and avoid the ambiguity of standards which caused by examiners positioning themselves as technical personnel in the field.[Conclusions]Through the principle of honesty and credit,and restrictions on simultaneous licensing or transfer of patents,the shortcomings of“three-step method”can be avoided.Finally,the legislative purpose of the principle of prohibiting double patenting has been achieved.
