摘　　要：新质生产力发展需要不断健全金融科技体制,提升金融科技服务产业发展的水平,打造与科技创新、产业发展全生命周期更相适配的金融科技服务方式。特别是在新模式、新技术的推动下,金融科技作为初始的技术走向金融产品,甚或新的金融产业,在面临金融本身存在多种风险的同时,也由于新模式、新技术的加持衍生更加复杂的多重风险,其迭变的速度较快,极易以科技创新之名规避金融监管。现阶段金融科技治理的法律规则尚不够完备,软法规则也有待完善。因此,有必要秉持多元规则协同、多元主体治理的理念,从“控制-命令”型监管转向多元规则协同共治的治理模式。制定更加完备的软法规则,并推动“软法硬化”,同时厘清伦理规则、技术规则对于金融科技发展的重要性,适时推动伦理规则、技术规则上升为软法规则,构建软硬法规则、伦理规则、技术规则三重规则下协同共治的金融科技多元治理规则体系,激励金融科技不断创新,推动金融科技健康可持续发展,助力经济高质量发展。The development of new quality productivity is essential for improving the fintech system,enhancing the level of fintech services for industrial development,and creating a fintech service mode that is more compatible with technological innovation and industrial development.There are many new risks,however,and it is easy to circumvent financial regulation in the name of technological innovation.At present,the legal rules for fintech governance are not yet complete,and the rules of so-called"soft law"need to be improved.Therefore,it is necessary to uphold a concept of synergy of multiple governance rules.It is necessary to formulate more complete"soft law"rules and promote the"hardening of soft law".At the same time,it is necessary to clarify the importance of ethical standards and technological rules for the development of fintech.It is also important to promote the upgrading of ethical and technological rules to soft law rules at an appropriate time.The ultimate goal is to build a multi-governance rule system to ensure the healthy and sustainable development of fintech and assist in the high-quality development of the economy.
