历史演进、规范内涵与宪法路径:人口增长同经济和社会发展相适应

摘　　要：优化人口发展战略,促进人口长期均衡发展,推动人口同经济、社会发展相协调,实现中国式现代化是当前的重要议题。宪法关于“使人口的增长同经济和社会发展计划相适应”的规定,具有深厚的立法渊源与时代内涵。通过宪法解释方法规范界定其深刻含义,认为实现人口同经济社会的协调发展难以单纯依靠生育政策影响,还需要更多关注妇女儿童权利、公民健康权,以及医疗卫生等多元社会权利体系。建议加强党中央集中统一领导人口工作,发挥中央决策议事领导机构职能;加快法律的立改废释工作,构建完善的法治保障体系;要认真落实宪法平等原则,保障妇女儿童权益;坚持实施“人口长期均衡发展”战略;要完善鼓励生育的政策支持体系,构建福利社会。同时,也要落实教育平等原则,提高人口素质深挖人口红利,进而推动人口高质量发展支撑中国式现代化。It is an important issue to optimize the population development strategy,promote the long-term balanced development of the population,promote the coordination of population with economic and social development,and realize Chinese modernization.The provisions of the Constitution on"adapting population growth to economic and social development plans"have profound legislative origins and connotations of the times.Through the method of constitutional interpretation,this paper defines its profound meaning,and holds that it is difficult to rely solely on the influence of fertility policy to realize the coordinated development of population and economy and society.More attention should be paid to the rights of women and children,the right to health of citizens,and the multi-social rights system such as health care.It is suggested to strengthen the centralized and unified leadership of the Party Central Committee in population work and give full play to the functions of the central decision-making and decision-making leading institutions;speed up the establishment,reform,abolition and release of laws,and build a sound legal guarantee system;we must earnestly implement the principle of constitutional equality and protect the rights and interests of women and children;adhere to the implementation of the'long-term balanced population development'strategy;it is necessary to improve the policy support system to encourage fertility and build a welfare society.At the same time,we should also implement the principle of equality in education,improve the quality of the population,deepen the demographic dividend,and then promote the high-quality development of the population to support Chinese modernization.
