摘 要:在中国古代文化中,“道”无疑是最高的范畴,由之产生了许多相关的优秀文化,如德文化的“君子之道”,政文化的“公正之道”和“明君之道”“清臣之道”等。在法文化中也产生了“法本乎道”和国家“治之以道”“以法治国”等优秀的观念。这些观念认为“法为道之用”,法是君子以人之道——“义”为基础,结合所在社会的客观实际为人们创制的行为准则或行为模式,从而也是体现和实现“义”的最有效方式,是社会治理之“至道”。显然,把“法”归之于“道”是非常深刻的,它有利于我们认识到“法”不仅是一种有用工具,而且是一种应信仰的价值目标。这对当前我国法治国家建设有非常重要的启迪价值。In ancient Chinese culture,Tao is undoubtedly the highest category,from which many related excellent ideas have emerged,such as the Tao of Junzi in virtue culture,the Tao of justice,wise emperor,and incorruptible officials in political culture.In the culture of law,there have also emerged excellent concepts such as“law is rooted in Tao”,and for the state to“govern by the Tao”,and“rule the country by law”.These concepts have been around for a long time and have been systematically and profoundly discussed.These concepts hold that the law is Tao’s practices,which is the behavioral norms or patterns created by the Junzi,basing on the moral principle of Yi in accordance with the objective reality of the society they live in.Therefore,it is also the most effective way to embody and realize Yi.It is the ultimate way of social governance.Obviously,the recognition that the law results from Tao is very profound,and it is also very important for the current construction of rule of law in China.Only with this recognition as a guide can we have a correct historical starting point for the construction of a country under the rule of law,and we can follow the Tao in the right path.The people will also come to believe in the law faithfully.
