摘 要:人口老龄化是今后较长一段时期我国的基本国情。真正实现“老有所为”是积极老龄化的题中之义和重要内涵之一。老年人是重要的劳动力资源,是从“人口红利”转向“人才红利”“长寿红利”的重要动力。对老年人就业的理论基础和社会现实需求的分析表明,保护老年人就业权益是我国实施积极应对人口老龄化国家战略背景下不可或缺的重要举措。与适龄劳动者相比,老年人在就业时面临着年龄歧视、工伤保险缺失、未能同工同酬等问题。从短期看,应立足现有法律,探求对老年人就业的相关权益保护;从长期看,应积极回应时代呼声与公众需求,立足劳动法理论和实践的创新发展,消解立法之间的矛盾,构建反年龄歧视规制体系,保障弹性退休制度有序进行。Population aging is the basic national condition of China for a long period of time in the future.Truly realizing the concept of"having a sense of purpose for the elderly"is one of the meanings and important connotations of active aging.The elderly are an important labor resource and a significant driving force for the shift from the"demographic dividend"to the"talent dividend"and"longevity dividend".The analysis of the theoretical basis and social reality needs of elderly employment shows that protecting the employment rights and interests of the elderly is an indispensable measure for China to actively respond to the national strategy of population aging.Compared with eligible workers,elderly people face issues such as age discrimination,lack of work-related injury insurance,and failure to receive equal pay for equal work in employment.In the short term,we should base ourselves on existing laws and explore the protection of the relevant rights and interests of the elderly in employment;in the long run,we should actively respond to the call of the times and public needs,innovate and develop based on labor law theory and practice,resolve contradictions between legislation,construct anti age discrimination regulatory system,and ensure the orderly implementation of flexible retirement systems.
