摘　　要：自动化行政处罚是行政处罚与人工智能相结合的产物,也是顺应法治政府建设的必然趋势。行政处罚法的相关规定与自动化设备在行政处罚中被广泛使用,分别为自动化行政处罚提供了法律基础和现实基础。但在实践中自动化行政处罚还存在系统构建过于理想化、程序保障机制不健全、监督和救济途径单一的困境,因此在构建自动化行政处罚系统时要注重设计与运行规则的科学性,处罚依据的合理性、处罚决定的透明度与可解释性;同时健全其程序保障机制,为行政相对人听证、申辩提供便利渠道,优化处罚决定的送达与执行流程;完善自动化行政处罚的监督与救济,是规范自动化行政处罚和保障相对人权益的有效途径。Automated administrative penalties are the product of the combination of administrative penalties and artificial intelligence,and they are an inevitable trend in the construction of a rule-of-law government.The relevant provisions of the Administrative Penalty Law and the widespread use of automated devices in administrative penalties provide the legal and practical basis for automated administrative penalties.However,in practice,automated administrative penalties still face challenges such as overly idealized system construction,inadequate procedural safeguards,and a lack of diverse supervision and remedy channels.Therefore,when constructing an automated administrative penalty system,it is essential to focus on the scientific design and operational rules,the rationality of the grounds for penalties,and the transparency and interpretability of penalty decisions.At the same time,it is necessary to improve the procedural safeguards to provide convenient channels for the parties involved to have hearings and make defenses,and to optimize the delivery and enforcement processes of penalty decisions.Enhancing the supervision and remedy mechanisms for automated administrative penalties is an effective way to regulate automated administrative penalties and protect the rights and interests of the parties involved.
