摘　　要：为提升中国海洋灾害应急管理法治水平与实际成效,推动海洋治理现代化,使海洋灾害应急管理在建设海洋强国中发挥更大作用,适应新时代的发展与要求,阐述了海洋灾害及应急管理概念,剖析中国海洋灾害应急管理体系与立法现状,包括体系构成、变迁历程及相关法律法规情况。同时以风暴潮、海浪灾害以及赤潮为切入点,深入分析中国海洋灾害应急管理法律体系存在的不足,进而提出完善建议,建立符合新时代发展的应急管理法律体系。To enhance the legal level and practical effectiveness of China's marine disaster emergency management,promote the modernization of ocean governance,and enable marine disaster emergency management to play a greater role in building a maritime power,adapting to the development and requirements of the new era,the concepts of marine disasters and emergency management were elaborated,the current state of China's marine disaster emergency management system and legislation was analyzed,including the composition of the system,its evolution,and related laws and regulations.The deficiencies in China's marine disaster emergency management legal system were also delved into by focusing on storm surges,wave disasters,and red tides.Subsequently,suggestions were proposed for improvement,aiming to establish an emergency management legal system that aligns with the development of the new era.
