摘　　要：高离婚率和畸高的房价成为目前我国社会的普遍现象,父母为子女出资购房的情况逐渐成为常态。然而这一现象带来的问题是出资款项的性质及产权归属往往无法界清,其中又混杂着社会伦理及多样的传统观念,从而形成了复杂的法律困境和伦理问题。文章深入分析父母出资购房的困境--出资行为的法律定性和债务归属问题,挖掘《民法典》中蕴含的深刻法理及司法实践中的现实考量,为研究和解决父母出资购房归属问题提供参考和启发。The high divorce rate and exorbitant housing prices have become common phenomena in contemporary Chinese society,and it is increasingly normal for parents to financially assist their children in purchasing homes.However,this phenomenon brings about issues regarding the nature of the financial contributions and the ownership of property rights,which often remain unclear.This is compounded by social ethics and various traditional concepts,resulting in complex legal dilemmas and ethical problems.This article deeply analyzes the dilemmas faced by parental financial contributions to home purchases-specifically,the legal qualification of the contribution behavior and the issue of debt ownership-while exploring the profound legal principles contained in“The Civil Code”and the practical considerations in judicial practice,providing references and insights for researching and resolving the ownership issues related to parental contributions in home purchases.
