刑事合规检察主导模式下的侦检角色反思

摘　　要：刑事合规制度改革已进入深水区,学界多着眼于合规程序具体制度研究,对于合规中的侦检角色却鲜有关注。刑事合规制度本土化过程中,侦检关系有着“侦检一体”还是“侦检分立”、“检主侦辅”还是“侦检协作”之问。我国刑事合规制度中的侦检关系应当遵循合理合法、包容审慎、独立行权、监督制约等原则;检察机关应当遵循必要的“介入”限制,构建侦查机关与检察机关双向互动协作机制;还应尝试突破机关本位思想,建立合规案件分流机制,根据罪行轻重匹配不同的诉讼流程和机关。The reform of the criminal compliance system has entered a deep water zone,and the research on the criminal compliance system in China’s legal academia is mostly focused on the specific system of compliance procedures,with little attention paid to the role of the investigation and prosecution in the criminal compliance system.In the process of localization of criminal compliance system,the relationship between investigation and prosecution has the question of“investigation and prosecution as a whole”or“separation of investigation and prosecution”,and the question of“main prosecution and detection”or“collaboration between investigation and prosecution”.investigation and prosecution collaboration.The construction of compliance investigation and prosecution collaboration model should follow the principle of reasonableness and legality,the principle of tolerance and prudence,the principle of independent exercise of power,the principle of supervision and control.China’s current criminal compliance system in the procuratorial organs of the system extension leads to“early intervention”in the investigation stage,should follow the necessary“intervention”restrictions.Constructing a two way interactive and cooperative mechanism between investigating authorities and procuratorial authorities.Attempts have been made to break away from agency based thinking and to establish a compliance case triage mechanism that partially transfers the responsibility for compliance management to the investigative authorities,matching different litigation processes and agencies according to the severity of the crime.
