从“法学生”到“法律人”——模拟法庭的法学教育隐喻

摘  要:法学教育与法律职业存在脱节现象,但各类模拟法庭的优胜者却颇受市场青睐。通过引入戈夫曼的拟剧理论,本文从法律人类学的角度观察了W大学法学院的模拟法庭赛队遴选、训练和比赛全过程,参赛选手在戏里戏外的场景变换中实现了从“法学生”到“法律人”的转变。主流法学教育中的“教育—实践”脱节体现于对综合能力培养的缺乏,强制选取矛盾立场的模拟法庭弥补了这一缺陷,有效促进了法学教育与法律职业的紧密联结。There is a disconnect between legal education and the legal profession,but winners of various moot court competitions are highly sought after in the job market.Through introducing Goffmans dramaturgy theory,this essay observes the entire process of selection,training,and competition of a moot court team at W University Law School from the perspective of legal anthropology.Participants in the competition underwent a transformation from“law students”to“law professionals”in the scene changes in and out of the play.The disconnection between education and practice in mainstream legal education is reflected in the lack of comprehensive skills training,which is remedied by the compulsory selection of contradictory positions in moot courts,effectively promoting a close connection between legal education and the legal profession.
