专利无效抑制了企业合作创新吗?

摘　　要：合作创新通过整合外部资源和知识,能够加速新技术的开发与市场化。理解专利无效对企业合作创新的影响是当前企业创新研究中的重要问题。本文利用2011—2023年中国沪深A股上市公司数据,通过构建多时点双重差分计量模型,考察了专利无效宣告对企业合作创新的影响效应和作用机制。结果发现:企业专利无效宣告后,企业与外部主体合作申请专利数量和与企业合作申请专利的外部主体数量显著下降,说明专利无效宣告这一冲击会导致企业合作创新深度和广度降低,抑制企业合作创新;异质性分析表明,相较于国有企业,非国有企业抗风险能力较弱,减少与外部主体合作的意愿更强。根据研究结论,建议加强专利保护和信息披露,优化专利审查流程,提升企业核心专利抗风险能力。Collaborative innovation accelerates the development and commercialization of new technologies by integrating external resources and knowledge.Understanding the impact of patent invalidation on enterprise collaborative innovation is a critical issue in current enterprise innovation research.Based on the data of Shanghai and Shenzhen A-share listed companies in China from 2011 to 2023,this paper examines the effect and mechanism of patent invalidation on cooperative innovation by constructing a multi-period difference-in-differences econometric model.The results show that after patent invalidation,the number of enterprises cooperating with external entities and the number of external entities cooperating with enterprises to apply for patents decreased significantly,indicating that impact of patent invalidation will reduce the depth and breadth of enterprise cooperative innovation and inhibit enterprise cooperative innovation.Heterogeneity analysis shows that non-state-owned enterprises have weaker risk resistance compared to state-owned enterprises and are more likely to reduce collaboration with external entities.It is recommended to strengthen patent protection and information disclosure,optimize invalidation review processes,and enhance the risk resistance of enterprises'core patents.
