我国社区家事纠纷调解中心的建构模式与运行机制

摘　　要：纠纷解决机制的设置应与纠纷的特性相适应,家事纠纷的身份性、情感性、隐私性、伦理性等特性,决定了其纠纷解决机制应采取多元处理方式。家事纠纷的非诉讼调解制度注重恢复和维护当事人之间的情感关系,有利于维护家庭和社会的和谐稳定。因此,有必要构建社区家事纠纷调解中心来满足我国家事纠纷非诉讼解决的实际需要。构建社区家事纠纷调解中心可采取政府扶持型和社会推进型两种模式,在运行中应加强社区家事纠纷调解中心的审查与监管,建立综合的考核评估机制。社区家事纠纷调解中心的基本职责包括家事纠纷的调解及预防、社区家事辅导与培训、家庭暴力受害人的保护和法制宣传等。同时,社区家事纠纷调解中心要不断完善社区家事调解人员管理制度,成立专职和兼职调解员队伍,实现调解人员专业化、职业化,并赋予调解员具有对与家事纠纷相关事实和状况进行全面调查的权力。The establishment of dispute resolution mechanisms should be adapted to the characteristics of the dispute.The identity,emotional,privacy,and ethical characteristics of family disputes determine that their dispute resolution mechanisms should adopt diverse approaches.The non-litigation mediation system for family disputes focuses on restoring and maintaining the emotional relationship between the parties,which is conducive to maintaining the harmony and stability of the family and society.Therefore,it is necessary to establish community family dispute mediation centers in China to meet the practical needs of non-litigation resolution of family disputes in China.The construction of community family dispute mediation centers can adopt two models:government support and social promotion.In operation,the review and supervision of community family dispute mediation centers should be strengthened,and a comprehensive assessment and evaluation mechanism should be established.The basic responsibilities of the Community Family Dispute Mediation Center include mediation and prevention of family disputes,community family counseling and training,protection of victims of domestic violence,and legal publicity activities.At the same time,standardize the management system for community family mediation personnel,establish full-time and part-time mediation teams,achieve professionalization and specialization of mediation personnel,and empower family dispute mediators with the power to conduct comprehensive investigations into facts and all situations related to family disputes.
