数据商参与的政府数据流通中个人信息使用与保护的三方博弈分析

摘　　要：作为数据要素市场建设的重要力量,数据商逐渐成为推动政府数据面向企业开放共享和交易的关键角色。政府数据流通需要解决公民个人信息使用和保护的矛盾冲突。通过构建数据商、政府、社会公众三方博弈演化模型,分析了三方动态博弈的演化路径。研究发现,三方博弈具有从不稳定状态向有条件稳定状态,再向稳定状态演化的阶段性特征。在此演化过程中,社会公众是否授权数据商代理其个人信息,是实现三方博弈稳定的关键因素。促进社会公众的授权,需要探索建立和完善个人信息使用与保护的分级分类、价值评估、利益分配、监管监督和阶段性激励等具体措施。As an important force in the construction of the data element market,data merchants have gradually become a key role in promoting government data to be open and shared with enterprises.The circulation of government data requires balancing the conflicts between the use and protection of personal information.By constructing a tripartite game evolution model among data merchants,government,and the general public,the evolutionary path of the tripartite dynamic game was analyzed.Research has found that the tripartite game has a phased characteristic of transitioning from an unstable state to a conditionally stable state,and then to a stable state.In this evolutionary process,whether the public authorizes data providers to act as agents for their personal information is a key factor in achieving stability in the tripartite game.To promote public authorization,it is necessary to explore and improve specific measures such as hierarchical classification,value assessment,benefit distribution,regulatory supervision,and phased incentives in the use and protection of personal information.
