摘　　要：我国金融法律存在修改频率低、间隔长和幅度小等问题,导致法律供给及时性不足,法律与金融实践的适应性亟待提升。为解决上述突出问题,推动金融高质量发展,有效防范化解金融风险,应建立金融定期修法制度,以适应金融实践发展需要。在构建与中国特色现代金融体系相适应的定期修法制度的过程中,除镜鉴不同法系成熟金融市场国家修法经验外,还宜考虑我国当前金融法律体系的主要制度短板,特别是长期未更新的法律制度与快速发展的金融业实践的适应性、匹配度不断下降等制约我国金融业高质量发展的关键问题。要在不同阶段和不同层次科学划定修法范围和期限,理顺机构改革后党中央机关、立法机关、金融主管部门的权责,有序推进相关制度建设。China’s financial laws suffer from issues such as infrequent revisions,lengthy intervals between revisions,and minor adjustments,leading to inadequate timeliness in legal provisions and a pressing need to enhance the adapability of the laws to financial practices.In order to solve the above problems,promote the high-quality development of finance,and effectively prevent and resolve financial risks,a system of regular financial law revision should be established to meet the evolving needs of financial practice.In the process of building a regular law revision system in line with the modern financial system with Chinese characteristics,we should examine the experience of law revision in mature financial market countries of different legal sys-tems and also consider the major institutional shortcomings of China’s current financial legal system.Espe-cially,we should focuse on the key issues that constrain the high-quality development of China’s financial industry,such as the decreasing adaptability and compatibility between the long-time non-updated legal sys-tem and the rapidly developing financial practice.In different stages and levels,it is necessary to scientifically delineate the scope and duration of law revision,rationalize the authority and responsibilities of the organs of the Party Central Committee,the legislature,and the competent financial authorities after the institutional reform,and promote the construction of the relevant systems in an orderly manner.
