论新时代中国环境权的特征

摘　　要：在百年未有之大变局背景下,环境权保障逐渐成为各国输出本国环境治理和人权法治理念,构建法治话语体系的主要路径。新时代中国环境权亟须系统化与本土化阐发。促进中国人权法学与环境法学自主知识体系的构建,亦有助于人与自然和谐共生的中国式现代化的实现。新时代中国环境权的特征可从五个主要面向加以阐释:新时代环境权保障立足于马克思恩格斯人与自然关系思想;新时代环境权主体拓宽的文化根基是中华优秀传统文化;习近平生态文明思想为拓展新时代环境权的客体引领方向;坚实的中国力量为新时代环境权保驾护航;新时代环境权法治保障向世界彰显了大国责任与担当。新时代环境权旨在激发并联合全体人类,共同努力推进人与自然和谐共生的现代化进程。新时代中国环境权的特征向世界展现了环境保护与人权保障的中国智慧。In the context of great changes unseen in a century,the protection for the right to environment has gradually become the main path for countries to export their own legal concepts of environmental governance and human rights,and to build a discourse system on the rule of law.Based on these,the right to environment in China in the new era need to be systematically and localized explicated,so as to help to build an independent knowledge system for environmental law and human rights law in China,and to help to realize the Chinese-style modernization of harmony between man and nature.The characteristics of the right to environment in China in the new era can be explained from the following five aspects:the right to environment in the new era is based on Marx and Engels thought on the relationship between man and nature;the cultural foundation of expanding the main body of the right to environment in the new era is Chinese excellent traditional culture;Xi Jinping's thought on ecological civilization leads the expansion of the object of the right to environment in the new era;the legal protection for the right to environment in the new era benefits from the solid strength support from various parties;the legal protection for the right to environment in the new era demonstrates the responsibility of China as a major power.The purpose of the right to environment in China in the new era is to inspire and unite all human beings to work together to promote the modernization process of harmonious coexistence between man and nature.All these characteristics show the Chinese wisdom in environmental protection and human rights protection.
