企业破产法与社会法的理念融合及制度衔接——基于职工权益保障的视角

摘  要:作为营商环境法治化中的两大法律制度,企业破产法与社会法统合于实质公平理念,通过共建社会安全网体系,共同作用于破产企业职工的权益保障。实现职工权益救济效果的最大化亟待促进两法救济功能的优化组合及加强制度的协同效应,其中两法的理念融合既是制度衔接的基础,也是破产法市场化实施的重要支撑。就职工权益保障而言,企业破产法的功能有限,主要是基于倾斜保护弱势群体的理念完善债权清偿的顺位规则。社会法的制度建设则应充分考虑企业破产因素,健全劳动法律法规,通过破产法中府院协调机制的拓展,进一步推进社会保险基金筹措的社会化,加强社会救助制度的兜底功能,在承认和尊重人格尊严的基础上有力保障职工基本权益的实现,从而完成两法层面的制度闭环。Bankruptcy Law and Social Law are two legal systems in the legalization of business enabling environment,which are integrated into the concept of substantive fairness,and a social safety net system should be built to jointly protect the rights of employees in bankrupt enterprises.To maximize the relief effect of employees'rights,it is urgent to promote the optimal combination of the relief functions of the two laws and strengthen the synergistic effect of the systems.The conceptual integration of the two laws is the basis of system convergence and an important support for the market-oriented implementation of bankruptcy law.The bankruptcy law has limited function to protect the rights of employees,mainly based on the concept of inclined protection of vulnerable groups to perfect the rule for the settlement of claims.The construction of social law system should fully consider the factors of enterprise bankruptcy,perfect labor laws and regulations,and through the expansion of the coordination mechanism between the government and the court in the bankruptcy law,promote the socialization of social security fund raising,strengthen the bottom function of social assistance system,vigorously safeguard the realization of basic human rights of employees on the basis of recognizing and respecting the dignity of the human person,and complete the closed loop of the system at the level of two laws.
