摘 要:存留养亲制度始于北魏,至清末废除,前后历时一千四百余年。清承明制,继承了明代存留养亲的相关条文,同时在处理具体案件的司法实践中逐渐形成了一系列完备的条例、则例和成案,对存留养亲进行了严密的规范。在诸朝法典中,清代对存留养亲制度的立法最为完备,也最有成效。作为统治者标榜的“法外施仁”的“宽政”,对清代统治者标榜孝治、推行礼教发挥了积极的作用。The system of permitting criminals to serve their elders,known as cun-liu yang-qin(存留养亲),was established in the Northern Wei Dynasty and lasted for more than 1400 years until its abolition in the late Qing Dynasty.Building upon the legal framework inherited from the Ming Dynasty,the Qing Dynasty further refined this system through judicial practices and gradually formed a complete collection of laws(tiao-li条例),regulations(ze-li则例),and cases(cheng-an成案),which strictly prescribed the conditions of cun-liu yang-qin.The cun-liu yang-qin of the Qing Dynasty was the most complete and effective among all dynasties.As a clement policy,it significantly contributed to the promotion of filial piety and the implementation of ritual propriety by the rulers.
