矿产资源资产所有权委托代理机制探析——基于资产收益分配视角

摘　　要：文章通过梳理我国矿产资源资产所有权的委托代理模式和链条,理清矿业权出让收益的分配结构和原则。委托代理机制是在所有权与监管权分离的基础上,对自然资源资产所有权进行委托代理;矿产资源资产所有权的委托代理清单和链条贯穿资产的形成、占有、使用、处置4个生命周期,其收益分配的共享机制受各环节、各级自然资源部门所承担权责多少的影响。基于对内蒙古自治区锡林郭勒盟全民所有自然资源资产委托代理试点实证分析,文章提出构建矿产资源资产收益分配机制的路径建议:①提高地方分成;②设立专用基金;③不同矿种设立委托目标;④重构投资收益机制;⑤依职责确定收益分配比例;⑥减少委托代理链中间环节。By sorting out the principle-agent mode and chain of mineral resource asset ownership in China,the paper clarifies the distribution structure and principle of mining rights transfer income.Based on the separation of ownership and supervision rights,the principle-agent mechanism carries out principle-agent for the ownership of natural resource assets.The principle-agent list and chain of mineral resource asset ownership run through the four life cycles of the asset,including formation,possession,use,and disposal,and its sharing mechanism of income distribution is affected by the power and responsibility of natural resource departments at each link and level.Based on the empirical analysis of the pilot project of entrusting and acting natural resource assets owned by the whole people in Xilingol League of Inner Mongolia Autonomous Region,the paper puts forward suggestions on the construction of income distribution mechanism of mineral resource assets:①increase the local sharing;②establish special funds;③set up entrustment targets for different mineral species;④reconstruct the ROI(return on investment)mechanism;⑤determine the income distribution ratio according to responsibilities;⑥reduce the intermediate links of the principal-agent chain.
