摘　　要：算法技术的应用使得传统共谋演变为诸多类型的算法共谋,具备了新特点。轴辐型算法默示共谋作为新型共谋之一,是指上下游经营者之间,一方利用算法技术为轴心与上下游经营者达成纵向共谋,同层经营者依托算法的实时监控,对市场价格的波动做出同类反馈,虽然没有垄断协议,但在事实上产生了限制竞争的效果,达成了横向默示共谋。与传统共谋相比,这类共谋不仅具有隐蔽性、易发性、稳定性更强的特点,也产生了现有反垄断体系难以规制的如共谋主体认定、行为意思联络,证据认定监管和主体责任分配不明确的难点,有必要在此基础上确定这类共谋反垄断规制的要点,包括扩展共谋主体范围,利用算法作为间接证据认定意思联络,完善监管体系人才队伍和明确主体责任分配,以期健全轴辐型算法默示共谋的反垄断规制体系。The application of algorithm technology has led to the evolution of traditional collusion into various types of algorithmic collusion,with new characteristics.As one of the new types of collusion,the hub-and-spoke algorithmic tacit collusion refers to the vertical collusion between upstream and downstream operators,where one party uses algorithm technology as the axis to reach a consensus with upstream or downstream operators,while the same-level operators rely on real-time monitoring of algorithms to provide similar feedback on market price fluctuations.Although there is no monopoly agreement,it actually has the effect of restricting competition and achieves horizontal tacit collusion.Compared with traditional collusion,this type of collusion not only has the characteristics of being more concealed,more likely to occur,and more stable,but also creates difficulties that are difficult to regulate in the existing anti-monopoly system,such as unclear identification of collusion subjects,communication of behavioral intentions,evidence identification regulation,and allocation of subject responsibilities.Based on this,it is necessary to determine the key points of anti-monopoly regulation for this type of collusion,including expanding the scope of collusion subjects,using algorithms as indirect evidence to identify communication of intentions,improving the talent team of the regulatory system,and clarifying the allocation of subject responsibilities,in order to improve the anti-monopoly regulation system of hub-and-spoke algorithmic tacit collusion.
