摘 要:游戏玩法的保护在司法实践中始终未能形成统一且具有可预测性的审判标准,甚至对于游戏玩法的可保护性、知识产权保护类型的认定都存在较大的争议。实践中大多都采取对游戏作品进行整体保护,将游戏作为视听作品进行著作权的认定。学术界在进行游戏玩法的性质认定时也多限定在著作权的“思想”“表达”二分法中对游戏玩法的“表达”性质的论证,但“思想”“表达”二分法无法认定仅抄袭设定框架、故事脉络等更为抽象的抄袭行为,日益隐蔽的侵权手法凸显了该认定方法的局限。游戏产业的高周转性决定了其无法承受时间较长的维权成本,实用新型要求的创造性要求不太高,而实用性较强,实用价值大,权利审批上采取简化审批程序、授权快、缩短保护期限、降低收费标准,更符合游戏玩法的性质定位。In judicial practice,a unified and predictable trial standard for the protection of gameplay has yet to be established.There are even significant disputes regarding the protectability of gameplay and the determination of the type of intellectual property protection.In practice,most often,the overall protection of game works is adopted,and games are recognized as audiovisual works for copyright determination.In the academic field,when determining the nature of gameplay.However,the“idea-expression”dichotomy cannot identify more abstract plagiarism behaviors such as merely copying the setting framework and story context.The increasingly covert means of infringement highlight the limitations of this identification method.The high-turnover nature of the game industry determines that it cannot afford the relatively long-term rights-protection costs.The utility model has a relatively low creativity requirement but a strong practicality and great practical value.In terms of rights approval,it adopts a simplified approval process,with quick authorization,a shortened protection period,and a low charging standard,which is more in line with the nature positioning of gameplay.
