摘 要:随着我国城镇化快速发展,土地低效利用和资源约束趋紧问题日益突出。推进城镇低效用地再开发是落实最严格节约用地制度、保障新型城镇化发展的必然要求。我国城镇低效用地再开发政策经历了“政策萌芽—试点探索—全面扩散”三个阶段的演进历程,呈现爆发式扩散特征,国家层面出台的法律文件和部门规章扩散频次和范围最大,具有非持久性。不同于行政审批政策工具,低效用地再开发激励机制呈显著的自下而上吸纳扩散态势。目前,我国城镇低效用地再开发缺乏明确的法律规范,政策扩散主要由行政指令驱动,内生动力不足,激励政策较为欠缺。建议加快制定低效用地再开发相关的法律法规,建立健全差异化的再开发政策体系,激发地方自主改造开发的积极性。With the rapid development of urbanization in China,the problems of underused land use and resource constraints have become increasingly prominent.The redevelopment of underused urban land is an inevitable requirement for implementing the strictest land conservation system and ensuring the development of new urbanization.The policy of underused urban land redevelopment in China has experienced three stages,namely,policy budding,pilot exploration and comprehensive diffusion.The diffusion characteristics of this policy are explosive and temporary,and the legal documents and departmental regulations issued at the national level have the largest frequency and scope of diffusion.Different from administrative approval policy tools,the incentive mechanism for underused land redevelopment shows a significant bottom-up diffusion among government levels.However,there are still no detailed laws for underused urban land redevelopment in China.The policy diffusion is mainly driven by administrative directives,and the incentive policies are relatively lacking.This leads to insufficient endogenous motivation for the policy diffusion.It is suggested to accelerate the formulation of laws and regulations related to underused land redevelopment.A differential policy system for underused land redevelopment should be established.Stimulating the enthusiasm for underused land redevelopment is of great significance.
