摘　　要：案例指导制度对法官自由裁量权有着双重影响,一方面,案例指导制度在司法实践中对法官的自由裁量权施加了一定的约束,另一方面,这一制度通过设置规范和标准,为法官在进行自由裁量时提供了依据和参考,给法官自由裁量权提供了保障。在某些复杂或特殊的案件中,严格依赖案例指导可能会造成对个案的“一刀切”,忽视案件的独特性,过于行使自由裁量权又会导致权利滥用和司法不公。法官在行使自由裁量权时,需要在遵循指导原则和考虑案件特殊性之间找到平衡,以确保判决的公平和合理。在实践中,需要不断探索和调整两者的关系,找到公平正义与法律适用的最佳平衡,实现案例指导制度与自由裁量权的良性互动,为法官提供适度的自由裁量空间,从而更好地实现公正、合理的审判。The case guidance system has a dual impact on judges’discretionary power.On the one hand,the case guidance system imposes certain constraints on judges’discretionary power in judicial practice.On the other hand,this system provides judges with guidelines and standards,providing them with reference and support for exercising discretion.It also provides judges with protection for their discretionary power.In some complex or special cases,strict adherence to case guidance may result in a“one-size-fits-all”approach,ignoring the uniqueness of the case,while excessive exercise of discretion may lead to abuse of rights and judicial injustice.Judges need to find a balance between following guidelines and considering the uniqueness of the case to ensure fair and reasonable judgments.In practice,it is necessary to continuously explore and adjust the relationship between the two,find the optimal balance between fairness and legal application,and achieve a positive interaction between the case guidance system and discretionary power,providing judges with moderate discretionary space,thereby better achieving fair and reasonable trials.
