摘　　要：对于袭警罪中受袭警察是否具有刑事被害人地位、是否应当享有赔偿请求权等附随权利,理论认识上有分歧、实践认定中有冲突。这些现象不利于袭警罪设立初衷的实现,不利于强化警察执法权、警察人身权的保护。应当明确受袭警察刑事被害人的诉讼地位,赋予其赔偿请求权等附随权利,并由检察机关对其享有的就民事权利损害进行刑事和解、收取赔偿金、出具谅解书等附随权利的行使进行约束和限制,从而实现充分保障受袭警察合法权益的同时防止其滥用相关权力的目的。There are differences in theoretical understanding and conflicts in practice as to whether the police officer who has been assaulted in the crime of assaulting police officers has the status of a criminal victim and whether he should en⁃joy the right to claim compensation and other ancillary rights.These phenomena are not conducive to the realization of the original intention of the establishment of the crime of assaulting police officers,and are not conducive to the achievement of the effect of strengthening the protection of the police officer's law enforcement power and the personal rights of the police of⁃ficer.The litigation status of criminal victims of the assaulted police officer shall be clarified,and ancillary rights such as the right to request compensation shall be given,and through the procuratorate shall regulate their ancillary rights such as criminal reconciliation for civil rights violations,receipt of compensation,and issuance of a letter of understanding.So as to achieve the goal of fully protecting the lawful rights and interests of the assaulted police officer while preventing them from abusing relevant rights.
