网络抢购服务类不正当竞争的判定要件——以陆金所金融产品网络抢购服务不正当竞争纠纷案为例

摘  要:经营者提供网络抢购服务应当遵循《反不正当竞争法》“互联网专条”的规定,不得利用技术手段,通过影响用户选择或者其他方式,妨碍、破坏其他经营者合法提供的网络产品或者服务的正常运行。在适用“互联网专条”兜底条款评价网络抢购服务是否构成不正当竞争时,除应考量其对目标平台以及用户利益是否造成损害外,还应审查是否具有不正当性。若网络抢购服务利用技术手段,破坏目标平台既有抢购规则,并刻意绕过其监管措施,对目标平台的用户粘性和经营生态造成严重破坏的,应当认定具有不正当性。在满足“损害+不正当性”的要件基础上,可判定该类网络抢购服务构成不正当竞争。Operators providing online rush purchase services must adhere to the provisions of Article 12(Internet related clause)of the Anti-Unfair Competition Law.No operator may,through technical means to affect users'choices,among others,interfere with or sabotage the normal operation of internet products or services legally provided by other operators.When applying the Miscellaneous Provisions of Article 12 of the Anti-Unfair Competition Law to judge whether online rush purchase services constitute unfair competition,consideration should not only be given to the damage caused to the targeted platform and users'interests but also to the unfair characteristics.If such services leverage technical means to undermine the established rush purchase rules of the target platform,deliberately circumvent its regulatory measures,thereby severely disrupting the user stickiness and business ecosystem of the target platform,they should be deemed improper.Meeting the requirements of“damage&unfairness”,such online rush purchase services should be determined as constituting unfair competition.
