安全与自由:我国金融数据跨境流动规制探析

摘　　要：在数字时代,数据作为新型生产要素的价值日益凸显,金融数据跨境流动日益频繁。美国对内通过《金融消费者隐私权法》和《金融服务现代化法》促进金融数据跨州自由流动,对外则通过缔结一系列自由贸易协定促进跨境数据流动。欧盟通过施行《通用数据保护条例》和《支付服务指令》,始终秉持金融数据安全流动和人权优先的立场。当前我国金融数据跨境流动规制存在着规则不适应金融行业发展、未实现场景化制度安排及有待体系化等问题。对此,我国应探索平衡数据安全流动和数据自由流动的张力,在防范重大金融风险的安全基础上促进金融数据自由流动,促进金融行业健康发展。具体来说,我国可以通过完善数据分级分类制度、推动金融数据规制场景化及建立白名单制度,以完善我国的金融数据跨境流动规制体系,实现数据安全保护和数据自由流动的激励相容。In the digital age,the value of data as a new factor of production has become increasingly prominent,and the cross-border flow of financial data has become increasingly frequent.Internally,the United States promotes the free flow of financial data across states through Right to Financial Privacy Act and Financial Services Modernization Act,and externally promotes crossborder data flow through free trade agreements.Through General Data Protection Regulation and the Payment Services Directive,the European Union has always upheld the position of the safe flow of financial data and the priority of human rights.At present,problems occur in China's regulation of cross-border flow of financial data.Rules are not suitable for the development of the financial industry and the scenario-based institutional mechanisms have not been realized as well as the rules need systematized.In this regard,China shall balance the relationship and promote the free flow of financial data on the basis of preventing major financial risks in order to promote the healthy development of the financial industry.Specifically by improving the financial data classification system,promoting the scenario-based financial data regulation,and establishing a whitelist system,China's financial data cross-border flow regulation system will be improved to achieve the compatibility of data security protection and data free flow incentive.
