摘　　要：有组织犯罪涉案财产处置是有组织犯罪预防和治理的应有之义。目前,我国有组织犯罪涉案财产处置存在调查取证有瑕疵、审查流于形式、论证说理不足、处置方式不规范以及利害关系人合法权益易受损等问题。究其原因,立法上表现为全面调查规则不尽周全、部分财产追缴范围不明确、各机关相互制约条款不足;司法运行上体现为涉案财产调查取证难度大、证明涉案财产权属证据欠缺、对涉案财产缺乏相对独立的庭审环节以及利害关系人程序参与度不高;法律监督方面反映出检察机关监督不力和社会监督受限。基于此,应从三个方面进行改进:一是完善涉案财产处置现行立法;二是规范涉案财产处置司法程序;三是优化涉案财产处置的监督方式。The disposal of assets involved in organized crime is a necessary aspect of organized crime prevention and governance.The Anti Organized Crime Law passed in 2021 provides a legal basis for the disposal of assets involved in organized crime in China.However,issues related to the disposal of assets involved in organized crime still need to be continuously explored and improved in conjunction with judicial practice.At present,there are problems with the disposal of assets involved in organized crime,such as flaws in investigation and evidence collection,formality in examination,insufficient argumentation and reasoning,non-standardized disposal methods,and susceptibility of the legitimate rights and interests of stakeholders to damage.The underlying reasons for these problems are manifold:legislatively,they manifest as incomplete comprehensive investigation rules,unclear scope of asset confiscation for some properties,and inadequate provisions for mutual checks among agencies;in terms of judicial operation,they present as the difficulties in investigating and collecting evidence related to the assets involved,the lack of proof regarding absence of relatively independent trial procedures for dealing with involved assets,and low participation of stakeholders in legal processes;from the perspective of legal supervision,they reflect inadequate supervision on the part of the procuratorial organs and limited social supervision.Based on this analysis,improvements should be made in three aspects:first,perfecting the current legislation concerning the disposal of assets involved in the case,second,standardizing judicial procedures for handling involved assets;and third,optimizing supervision methods for the disposal of involved assets.
