摘　　要：发展数字贸易需要对接数字贸易国际规则,RCEP、CPTPP、DEPA作为数字贸易主流规则,由于主导国家和成员国数字经济水平不同且各有特色,在核心议题上既有共性也存在差异。我国虽已初步构建起包括国内立法、试点区域开放政策、参与双边和多边自贸协定、数字治理国际倡议的数字治理体系,但与数字贸易主流规则相比仍存在差异,影响了我国数字贸易发展和数字治理话语权。对接高标准数字贸易国际规则,RCEP可作为参与构建全球高标准数字贸易规则的基础;申请加入CPTPP可作为提升在更大范围、更高标准内参与数字贸易规则的重要途径;DEPA可作为参与构建全球数据治理体系的重要平台优先推进加入进程。以自贸区(港)为制度型试验区,充分考量与CPTPP、DEPA在关键规则条款上存在的差异,统筹开放与安全,实现高标准对接。The development of digital trade needs to be aligned with international rules on digital trade.RCEP,CPTPP and DEPA,as the mainstream rules of digital trade,have both commonalities and differences in core issues due to the different levels of digital economy of the leading countries and member states and their re⁃spective characteristics.Although China has initially constructed a digital governance system that includes domes⁃tic legislation,pilot regional openness policies,participation in bilateral and multilateral FTAs,and international initiatives on digital governance,there are still discrepancies compared with the mainstream rules of digital trade,which affects China's development of digital trade and its right to speak on digital governance.Docking to highstandard international rules on digital trade,RCEP can serve as the basis for participation in building global highstandard digital trade rules;applying for membership in CPTPP can serve as an important way to enhance partici⁃pation in digital trade rules in a wider scope and at a higher standard;and DEPA can serve as an important plat⁃form for participation in building a global data governance system to prioritize the accession process.Taking the FTAs(FTP)as a system-based test area,it should fully consider the differences with CPTPP and DEPA in terms of key rules and regulations,integrate openness and security,and realize high-standard docking.
