建设工程无效合同的相对性问题探讨

摘　　要：研究建设工程合同无效的情形下,利益相关的当事人能否突破合同相对性来主张自身权益。文章首先对合同无效与建设工程合同无效的法定情形及其法律后果做了阐述;然后对合同相对性原则和合同相对性原则突破的原因,以及建设工程突破合同相对性的主要法定情形做了分析;最后就合同相对性原则与突破在建设工程无效合情形下的适用性做了分析和探讨。相对性特征为合同的特定存在,不论建设工程合同是否有效,均适用合同相对性原则。但在建设工程合同无效情形下,其突破合同相对性原则的方式则应当不再适用。理解并运用好合同相对性原则,以及突破合同相对性的情形和要素,对建设工程合同无效情形下,有关当事人维护自身权益并挽回有关损失具有重要的意义。In order to study whether the interested parties can break through the relativity of contract to claim their own rights and interests in the case of invalid construction project contract,this paper first expounds the legal circumstances and legal consequences of the invalidation of contract and the invalidation of construction project contract,and then analyzes the reasons and circumstances of the breakthrough of the principle of contract relativity,and the main legal circumstances of construction projects breaking the relativity of contracts.Finally,the applicability of the principle of contract relativity and breakthrough in the case of invalid construction project is analyzed and discussed.The relativity feature is the specific existence of the contract.Regardless of the validity of the construction contract,the relativity principle of contract is applicable.However,in the case of invalid construction contract,the way of breaking the principle of contract relativity should no longer be applicable.Understanding and applying the principle of contract relativity well,as well as the circumstances and elements that break through the relativity of contract,are of great significance for the parties concerned to safeguard their rights and interests and recover the relevant losses in the case of invalid construction contracts.
