摘　　要：商事仲裁目前已成为诉讼外重要的争议解决方式之一,近年来全国仲裁机构受理商事仲裁案件的数量及标的额持续增长,案件类型的范围也随之扩大。随着商事案件数量及类型持续增长,复杂的商事案件也越来越多,大量案件中存在举证困难、需仲裁庭调查取证的情况。根据笔者的实务经验,我国商事仲裁实务中往往存在仲裁庭作出的“协助调查函”无强制力的情形,加之公众及各单位企业对商事仲裁的认识、配合程度不足,往往会影响到调查取证的结果。本文将探讨商事仲裁程序中仲裁庭调查取证的权力基础、可能方式及范围,并试图对比各仲裁机构规则的规定、不同地区相关制度的内容、相关实践经验。最后本文将结合上海市闵行区人民法院办理的首例法院依仲裁机构申请开具调查令案件,探究商事仲裁程序中仲裁庭调查取证可行的路径。Commercial arbitration has become one of the most important methods for dispute resolution besides litigation.In recent years,the number and total amount of commercial arbitration cases accepted by arbitration institutions across the country have continued to increase,and the types of cases accepted have also expanded.As the number and types of commercial cases continue to soar,the number of complicated commercial cases increases as well.In many cases,it is difficult to produce evidence,which requires the arbitration tribunal to conduct investigations and collect evidence.Based on the author’s experience,in the practice of Chinese commercial arbitration,the“Letter of Assistance to Investigation”issued by the arbitration tribunal is often not enforceable.In addition,the public and enterprises often lack sufficient understanding and cooperation with commercial arbitration,the results of investigation and evidence collection will often be affected.This article will discuss the power base of investigation and evidence collection by the arbitration tribunal in commercial arbitration,possible methods and the scope of investigation and evidence collection,and try to compare and contrast the rules of each arbitration institution,relevant rules in different regions,and related practices.Finally,based on the first case in which the Minhang District People’s Court of Shanghai issued an investigation order upon an application by an arbitration institution,this article will discuss possible methods of investigation and evidence collection by arbitration tribunals in commercial arbitration.
