摘  要:随着生成式人工智能技术的颠覆式发展,人工智能在仲裁领域的应用得到了学者和仲裁从业人员的关注。仲裁需要凭借申请书和答辩书、证据材料、庭审记录以及相关法律法规等结构化程度高的法律数据作出裁决。此外,无论是仲裁程序性工作还是最终裁决都需要输出标准化、格式化文件,这些条件为仲裁“智能化”提供了可能性。本文首先分析生成式人工智能未来在仲裁工作中的典型应用场景。其次根据技术发展和仲裁场景特征,设定智能化仲裁的等级划分。最后分析生成式人工智能应用于仲裁中的机遇和挑战。在生成式人工智能大幅提高仲裁工作效率的同时,也要警惕其潜在威胁和风险。The revolutionary advancement of generative artificial intelligence technology has drawn the attention of scholars and practitioners in the field of arbitration.Arbitration requires making decisions based on application forms and statements of defence,evidence materials,court transcripts,and related laws and regulations,which are highly structured legal data.Furthermore,both arbitration procedural work and the final verdict have to generate standardized and formatted files.These offer the potential for arbitration to be intelligentized.This study begins by analyzing the typical application scenarios of generative artificial intelligence in arbitration work.Next,based on technological advancements and specific features of arbitration scenarios,a classification of intelligent arbitration levels is established.Finally,the opportunities and challenges of applying generative artificial intelligence in arbitration are discussed.Despite the considerable benefits of utilizing artificial intelligence to improve the efficiency of arbitration,it is pivotal to be constantly aware of the potential threats and risks.
