摘　　要：构建新型职业农民工伤保险制度,是培育和壮大新型职业农民队伍、实现乡村振兴战略目标的重要制度保障。该制度的构建需要我国农民内涵实现从“身份”到“职业”的回归,并且是未来“职业农民”工伤保险制度构建的重要突破口。将新型职业农民纳入工伤保险保障,符合工伤保险制度“职业风险”和“保障需要”的本质属性,顺应“工伤保险社会保障化”趋势,践行“以人民为中心”的发展思想,并且拥有制度空间、试点实践和先行经验作为制度支撑,因此具有必要性与可行性。新型职业农民工伤保险制度不能完全照搬传统工伤保险的相关规则,经验的比较借鉴具有重要意义。德国、日本和我国台湾地区的制度经验能够提供一些具体细致的指引。我国新型职业农民工伤保险制度的构建应试点先行,相关规范性文件应当对制度构成要件和配套措施予以阐明,前者包括保障对象、加保方式、缴费主体、费基、费率、工伤待遇支付、工伤认定等制度规范,后者包括立法层级、立法模式的明确。Building a new professional farmer work-related injury insurance system is an important institutional guarantee for cultivating and strengthening the new professional farmer team,achieving the strategic goals of rural revitalization.The construction of this system requires the return of the connotation of Chinese farmers from“identity”to“profession”,and is an important breakthrough in the future construction of professional farmer work-related injury insurance system.Incorporating new professional farmers into work-related injury insurance protection is in line with the essential attributes of“occupational risk”and“protection needs”of the Work-related Injury Insurance Law,conforms to the trend of“social security of work-related injury insurance”,practices the development concept of“putting the people at the center”,and has institutional space,pilot practice,and external experience as institutional support.Therefore,it is necessary and feasible.The new professional work-related injury insurance system cannot completely copy the relevant rules of traditional work-related injury insurance.The comparison and reference of foreign experiences are of great significance.The relevant systems in Germany,Japan,and Taiwan District of China provide specific and detailed guidance.The construction of a new professional farmer work-related injury insurance system in China should be piloted first,and relevant normative documents should clarify the constituent elements and supporting measures of the new professional farmer work-related injury insurance system.The former includes institutional norms such as protection objects,additional insurance methods,payment subjects,fee bases,rates,payment of work-related injury benefits,and recognition of work-related injuries;The latter includes the clarification of legislative levels and legislative models.
