摘　　要：当前数智赋能公共文化服务均等化形成了“中央立法+地方立法”“一般性领域规范+专门性领域规范”的法治型态,但是仍存在制度软约束、失衡与“鸿沟”、安全风险等困境。为此,《公共文化服务保障法》等现有法律体系应积极顺应新技术发展的浪潮,有效构建并优化公共文化服务的数智化系统,以数字化的服务内容、一体化的服务标准、平台化的服务方式为核心要素,实现公共文化服务的充分性、普惠性、可及性,促进公共文化服务供给的充分与平衡。同时,从夯实公共数字文化服务法律规范、明确事权与支出责任划分、强化财政转移支付等政策性扶持、平衡公共文化服务数据权利配置等方面规范数智赋能公共文化服务均等化的有序运行,为公共文化服务数智化发展提供体系化的法治保障。At present,digitization intelligence has formed a legal framework characterized by“central legislation+local legislation”and“general field norms+specialized field norms”within the realm of public cultural services,but there are still challenges such as policy vagueness,imbalances and disparities as well as security risks.To this end,the existing legal systems such as the Public Cultural Service Guarantee Law can actively follow the wave of new technology development,effectively build and optimize the digital and intelligent system of public cultural services,specifically with digital service content,integrated service standards and platformized service mode as the core elements to realize adequacy,inclusiveness and accessibility of public cultural services to promote the adequacy and balance of the supply of public cultural services.At the same time,from the aspects of consolidating the legal norms of public digital cultural services,clarifying the division of power and expenditure responsibilities,strengthening policy support such as financial transfer payments,balancing data right disposition of public cultural services,the orderly operation of digital intelligence empowering public cultural services is thus standardized,so as to provide a systematic rule of law for the digital intelligent development of public cultural services.
