渔业行政执法“不予行政处罚”法律规制研究

摘　　要：“不予行政处罚”条款的模糊性和不确定性,导致其在渔业行政执法实践中的适用上面临诸多困境。为突破这一桎梏,亟需对渔业行政执法“不予行政处罚”条款的法律规制进行进一步完善。文章通过对渔业行政执法与不予行政处罚的内涵进行分析,并指出渔业行政执法“不予行政处罚”条款适用中存在的“轻微不罚”条款适用不清晰、“主观过错”条款地位及证明标准存在争议,以及“初次不罚”界定标准不明等现实问题,提出了统一渔业行政执法“轻微不罚”适用标准、明确渔业行政执法“主观过错”条款法律规范以及完善渔业行政执法“初次不罚”规范体系的可行性路径,以期为渔业行政执法“不予行政处罚”规则的适用提供有益借鉴。The fuzziness and uncertainty of the “no administrative punishment” clause lead to its application in fishery administrative law enforcement practice facing many difficulties.In order to break through this shackle,it is urgent to further improve the legal regulation of "no administrative punishment" clause in fishery administrative law enforcement.This paper analyzes the connotation of fishery administrative law enforcement and non-administrative punishment,and points out the practical problems existing in the application of the "no administrative punishment" clause of fishery administrative law enforcement,such as the unclear application of the "minor impunity" clause,the controversial status and proof standard of the "subjective fault" clause,and the unclear definition standard of "initial impunity".This paper puts forward a feasible path to unify the applicable standard of "slight impunity" in fishery administrative law enforcement,clarify the legal norms of "subjective fault" clause in fishery administrative law enforcement and improve the normative system of "initial impunity" in fishery administrative law enforcement,in order to provide useful reference for the application of the "no administrative punishment" rule in fishery administrative law enforcement.
