摘　　要：【目的】揭示当下网络名人姓名商标恶意抢注问题的规制困境,就完善网络名人姓名商标恶意抢注问题提供可行性建议。【方法】通过分析网络名人姓名商标发展现状及用于规制商标恶意抢注的法律依据,梳理网络名人姓名商标恶意抢注现象及司法实践。【结果】相关部门应提升恶意抢注网络名人姓名商标行为的违法成本,建立和完善网络平台用户名及账号的注册审核机制,增强公众的知识产权保护意识。【结论】构建部门协同、上下联动、社会共治的工作新格局,还网络名人一份应有的姓名尊重与法律保障。[Purposes]This paper reveals the current regulation dilemma of malicious registration of internet celebrity's name trademark,and tries to provide feasible suggestions for improving the problem of malicious registration of internet celebrity's name trademark.[Methods]By analyzing the development status of online celebrity name trademark and the relevant legal basis to regulate the malicious registration of trademark,the phenomenon of malicious registration of online celebrity name trademark and related judicial practice are reviewed.[Findings]Relevant departments should increase the illegal cost of mali⁃cious internet celebrity name trademark squatting,establish and improve the registration and auditing mechanism of network platform user names and accounts,and enhance the public’s awareness of intellectual property protection.[Conclusions]It is recommended to build a new work pattern of department coordination,upper and lower linkage,and social cogovernance,and also give network celebrities a due name respect and protection..
