摘　　要：【目的】从专利申请和专利审查的角度出发,对“权利要求应当以说明书为依据”的判断思维、适用规则和说理逻辑进行研究,帮助专利申请人和审查员准确把握该法条的执行尺度,提高专利质量。【方法】以立法宗旨为基础,结合通信领域的实际案例,对过度质疑、概括不当和法条竞合等常见问题进行分析,探讨该法条的理解与适用。【结果】权利要求的保护范围应当与说明书公开的内容一致,确保授权专利的权利范围与申请人的技术贡献相匹配。【结论】通过对上述问题进行分析,以期促进专利质量的提升,确保专利权的稳定性。[Purposes]From the perspective of patent application and examination,this study aims to investigate the judgment thinking,application rules,and reasoning logic that claims should be based on the description,in order to help patent applicants and examiners accurately grasp the execution scale of this provision and improve patent quality.[Methods]Based on the legislative purpose and combined with practical cases in the field of communication,this paper analyzes common problems such as excessive questioning,improper generalization,and competition of legal provisions,and explores the understanding and application of this legal provision.[Findings]The scope of protection required by the claims should be consistent with the content disclosed in the description,ensuring that the scope of protection of the authorized patent matches the technical contributions made by the applicant.[Conclusions]Through the analysis of the aforementioned issues,this study aims to promote the improvement of patent quality and ensure the stability of patent rights.
