摘 要:地区政府间流域生态保护补偿协议在中国已有超过10年的制度实践,对其实施效果有重新估量和考察的必要。剖析补偿协议的理论预期,形式上具有延展权限、加强合作的目标,实质上具有合理摊销成本、保障治理公平、优化流域国土空间的重任。然而,以19份补偿协议为分析样本予以实际考察可发现,形式层面基本达到理论预期,而实质层面则主要强化了水污染防治。从合目的性检视,补偿协议中实质内容之所以未达预期,主要在于资金短缺无法弥补治理成本、公平失衡导致地区发展不均、要素脱节造成系统调节受限。欲解决上述问题,可在补偿协议中增加调整出资比例、动态调节机制、机会成本核算和产业补偿等具有实质意义的内容,使补偿协议更加有效、公平、可持续地为流域治理服务。The inter-regional governmental compensation agreement for river basin ecological protection has been implemented in China for more than 10 years,and it is necessary to reassess and examine its implementation effect.By analyzing the theoretical expectation of the purpose of the compensation agreement,it is found that the formal purpose is to expand authority and strengthen cooperation,while the substantial purpose is to reasonably amortize costs,ensure fair governance,and optimize the territorial space of the river basin.However,based on the actual examination of 19 compensation agreement samples,this paper found that the formal purpose stated in the content of the agreements has been basically achieved,while the substantial purpose only strengthened water pollution prevention and control.Through the purpose-oriented review,the reason why the substantial content in the compensation agreement did not meet expectations is mainly due to the inability to cover the governance costs due to funding shortages,the imbalance of fairness leading to uneven regional development,and the limitation of system regulation caused by the disconnection of elements.To solve the above problems,it is recommended to add substantial contents such as adjusting the funding proportion,dynamic adjustment mechanisms,opportunity cost accounting,and industrial compensation to the compensation agreement,so that the compensation agreement can serve river basin governance more effectively,fairly,and sustainably.
