摘 要:《唐律疏议》作为现存最早最完备的法典,是中华法系的成熟形态,集中代表了儒法国家的法治特征。本文以之为中心,结合唐初诏敕令式和行政司法实践,以传播学视角依次从传播内容、传播渠道、传播对象切入,探讨这一法典在应对民间宗教传播、处置民间聚众结社、管控民众日常出行交往等方面的制度设计。从初唐到盛唐的这一时期,中外文化交流高涨,民间交往活跃,唐朝统治者为了维系政治安全和社会稳定,通过法制化、行政化的方式配合正统观念的引导,化解文化交流带来的压力,整合异质文化从而实现对民间社会传播的管控。在这一系列成文法制与变通政策背后起着指导作用的,则是传统理想对于等级秩序与价值体系的终极追求。The present study focused on“Tang Lu Shu Yi”,the very code representing the feature of the rule of law in the Confucian-legalistic State of imperial China.As the earliest and most complete code in existence,it was the mature form of the Chinese legal system.According to those remaining decrees and administrative practices before the An-Shi Rebellion,our research explored the system design of law in Tang dynasty via how the law responded to the spread of folk religions,dealt with folk gatherings and associations and managed people's daily travel and communication.From the early to the prosperous Tang Dynasty,the cultural exchanges between traditional China and foreign countries and people-to-people communication were dynamic and active.Given those,to maintain political security and social stability,rulers of Tang Dynasty took advantage of legalization and administration to coordinate with the cultivation of orthodox ideology,which alleviated the pressure of cultural exchange,integrated the heterogeneous cultures and eventually managed civil society communication.It's the very pursuit of hierarchical order and traditional value that behind all these written laws and fexible policies.
