内地与香港地区继承判决流通制度的构建

摘　　要：内地与香港地区现有的区际民商事判决认可和执行安排均不适用于继承判决,两地继承判决的认可和执行缺乏法律依据,造成跨境继承困境。现有的证据采信路径、内地公证路径和香港地区认证路径均有助于推进跨境继承事宜处理,但这些路径依赖于两地各自单方立法,制度差异较大且不具有既判力效果,不能全面高效地实现继承判决的自由流通。构建内地与香港地区继承判决认可和执行制度的根本在于协调与衔接内地的直接继承机制与香港地区的间接继承机制。在充分尊重法律制度差异、寻求最大共识的基础上,内地与香港地区应构建继承判决的多元流通路径,包括创建继承判决认可和执行路径,整合现有内地公证路径、香港地区认证路径和继承判决证据采信路径,探索推行区际继承证书制度,从而实现继承判决的自由流通,提升跨境继承事宜的办理质效,助力大湾区融合发展。Succession judgments are excluded from the scope of application of the existing arrangements for the recognition and enforcement of judgments in civil and commercial matters between the Mainland and Hong Kong region of China.The lack of a legal basis for the mutual recognition and enforcement of succession judgments gives rise to practical dilemmas in cross-border succession between the Mainland and Hong Kong region.Although the current approaches to evidence admission,notarization in the Mainland and probate in Hong Kong region contribute to the handling of cross-border succession matters,they all rely on unilateral legislation in their respective jurisdiction,resulting in significant institutional differences and a lack of res judicata effect,thus failing to achieve the comprehensive and efficient free circulation of succession judgments.The fundamental aspect of constructing a system for mutual recognition and enforcement of succession judgments between the Mainland and Hong Kong region lies in the coordination and integration of the direct succession mechanism in the Mainland with the indirect succession mechanism in Hong Kong region.On the basis of fully respecting the differences between legal systems and seeking maximum consensus,it is necessary to construct diverse approaches to the circulation of succession judgments between the Mainland and Hong Kong region,including creating an approach to the mutual recognition and enforcement of succession judgments,integrating the existing approaches of notarization in the Mainland,probate in Hong Kong region,and evidence admission of succession judgments,and exploring a system of inter-regional succession certificate,so as to achieve the free circulation of succession judgments,enhance the quality and efficiency of handling cross-border succession matters,and facilitate the integrated development of the Greater Bay Area.
