摘　　要：《北京市中水设施建设管理试行办法》(简称《办法》)是我国首部关于建筑中水利用的地方性政府规章。《办法》施行37年来,中水回用取得了一定的社会效益和环境效益。但随着《北京市节水条例》和《节约用水条例》的相继实施,新时期的社会用水需求也发生了变化,仅在2010年进行了修订的《办法》中的部分条款已经不适应北京市再生水回用综合布局需求。结合《办法》实施以来遇到的实际问题,分别从合法性、合理性和实施有效性等方面进行剖析,并从法规衔接、职责划分、运行监管主体、培训考核及处罚、中水水质指标等方面提出相关建议,可为后续《办法》修订及实施提供参考。“Tentative measures for the construction and management of reclaimed water facilities in Beijing”(referred to as“Measures”)is the first government regulation in China regarding the utilization of reclaimed water system for building.The“Measures”has been implemented for 37 years.The reuse of reclaimed water system has achieved cer-tain social and environmental benefits.However,with the successive implementation of“Beijing water saving regu-lations”and“Water saving regulations”,the reclaimed water demand of the new era has changed,and some provi-sions of the revised regulations in 2010 are no longer suitable for the comprehensive layout of reuse of reclaimed water in Beijing.Combined with the practical problems encountered since the implementation of the“Measures”,the anal-ysis was conducted from the aspects of legality,rationality and effectiveness of implementation.From the perspective of the connection with other laws and regulations,the division of responsibilities of reclaimed water,relevant sug-gestions were put forward to provide reference for subsequent revision and implementation of measures.
