生态环境法典编纂研究创新之思考

摘　　要：生态环境法典编纂研究已经取得丰富成果,既达成了基本学术共识,也为生态环境法典编纂提供了“人与自然和谐共生”的法哲学基础、“生态理性经济人”的人性标准,以及建构“人—自然—人”新型法律关系的理论支撑。下一步,生态环境法典编纂的理论与实践创新重点在于,以习近平生态文明思想和法治思想的法典转化为基础,推动法典编纂的范畴、原则、体制、体系、制度及全球环境治理等方面的全面创新。继续推进生态环境法典编纂研究,须准确把握生态环境法典的编纂目标及法典化表达方式,正确理解以法典立法方式固化生态文明体制改革成果,认真对待环境司法实践经验法典化,妥善处理法典内外部法律规范之间的关系。Significant progress has been made in the study of codifying ecological and environmental law,with a basic academic consensus now established.Efforts and achievements in this regard have laid a solid foundation for codification by providing the philosophical principle of“harmonious coexistence between man and nature”,the human standard of the“ecologically rational economic individual”,and the theoretical basis for constructing a new legal relationship between man and nature.Looking ahead,the focus of innovation in both theory and practice will be on transforming the Xi Jinping Thought on Ecological Civilization and the rule of law into codified legal frameworks.This transformation will drive comprehensive advancements in the scope,principles,structure,system,mechanisms,and global environmental governance of the code.To further promote research on ecological and environmental law codification,it is essential to precisely define its objectives and codification methods,effectively consolidate the achievements of ecological civilization reforms through legislative codification,systematically incorporate judicial practices into the code,and carefully balance the relationships between internal and external legal norms.
