摘 要:司法所的垂直管理改革在全国各地广泛推行,但这项改革使得司法所的组织运行面临诸多困境,最终在实践中回归到属地管理的模式。以往的研究仅从组织效率或治理风险来解释属地管理或垂直管理的体制选择,忽视了基层治理情境的影响。研究发现,基层司法所的业务综合性强,加之组织本身资源缺乏,组织职能的实现需要借用街道的权威获得其他部门的协同,并依靠工作人员长期以来建立的在地社会关系网络。当组织嵌入和社会嵌入都出现困境时,司法所垂直管理改革的预期目标注定难以实现。The vertical management reform of judicial offices has been widely implemented throughout the country,but this reform has caused many difficulties in the organizational operation of judicial offices,ultimately returning to the mode of territorial management in practice.Previous studies have only explained the institutional choices of territorial or vertical management based on organizational efficiency or governance risks,ignoring the impact of grassroots governance contexts.Research has found that grassroots judicial offices have strong business comprehensiveness,coupled with a lack of organizational resources.The realization of organizational functions requires borrowing the authority of the street to obtain collaboration from other departments,relying on the local social relationship network established by staff for a long time.When both organizational and social embeddedness encounter difficulties,the expected goals of vertical management reform in the judiciary are bound to be difficult to achieve.
