摘　　要：网络暴力事件中侮辱诽谤罪是最常见的罪名,该罪如何适用公诉程序成为司法焦点。针对实体与程序、自诉与公诉的双重交叉问题,仍有反思的必要。实体层面,应当对“社会秩序”“国家利益”等核心概念进行严格解释,明确区分公诉条件与“情节严重”这一入罪标准,并且坚持多维度判断,将行为人主观意图及事后悔罪表现等纳入综合考量,以完善侮辱诽谤罪公诉规则。程序层面,为避免检察机关权力滥用、构建系统的程序转换机制,应当从立法论角度出发,明确自诉与公诉衔接的时间节点、厘清检察机关的权力边界并规范统一的自诉终结方式,从而真正实现依法治网。The crime of insult and defamation is the most common crime in cyber-violence,and the application of the public prosecution procedure for this crime has become a judicial focus.Further reflection is needed on the dual intersection of substantive and procedural law,as well as the transition from private to public prosecution.At the substantive law level,core concepts such as“social order”and“national interest”should be strictly interpreted,and a clear distinction should be made between the conditions for public prosecution and the criterion of“serious circumstances”.Furthermore,a multi-dimensional approach is essential,incorporating the perpetrator’s subjective intent and post-offense remorse into comprehensive assessments,to refine the public prosecution rules for internet insult and defamation crimes.At the procedural law level,to prevent the abuse of power by prosecutorial authorities and to establish a systematic procedural conversion mechanism,the timing for the transition from private prosecution to public prosecution should be clarified from the perspective of legislative theory,the boundaries of the power of prosecutorial authorities should be defined,and a unified method for concluding private prosecutions should be standardized,thereby truly realizing lawful internet governance.
