我国体育高质量发展的逻辑转换与法律因应——从新修《体育法》增加“体育产业”专章切入

摘  要:以“举国体制”发展体育的传统逻辑虽然为我国取得了优异的竞技体育成绩,却带来竞技体育对群众体育引领普及、提高转化缺失以及体育产业羸弱等诸多问题,具有不可持续性。市场化转型成为推动体育新发展的决定性力量,运动员培养双轨制破冰、复合式人力资本产权归属争议、社会资本对体育产业活力的激发,均显示出体育事业向体育产业市场化转轨的趋势。在市场逻辑下,体育产业推动和体育消费培育都需要法律制度作出相应的回应。在产业推动方面,应廓清政府与市场的关系,规范体育社会组织的定位与职权范围,建立跨部门、跨区域的体育产业议事协调平台;在体育消费培育方面,应促进体育产业供给侧改革,增强运动内容趣味性并保障头部品牌创新产权,构建为体育产业发展注入政府意图的法律通道,完善公与私融合转化的产权体系,加强对体育无形资产的保护。Although the traditional logic of developing sports under the“whole nation system”has achieved excellent competitive sports results for China,it has brought about many problems,such as the lack of popularization and transformation of competitive sports into mass sports and the weakness of the sports industry,which is unsustainable.Market-oriented transformation has become the decisive force to promote the new development of sports.The breaking of the ice of the dual-track system of athletes’training,the disputes over the property rights of composite human capital,and the stimulation of the vitality of social capital to the sports industry all show the trend of the market-oriented transformation of sports undertakings to the sports industry.Under the logic of market,the promotion of sports industry and the cultivation of sports consumption both need the legal system to make corresponding responses.In terms of industry promotion,the relationship between the government and the market should be clarified,the positioning and terms of reference of sports social organizations should be regulated,and a cross-sectoral and cross-regional sports industry coordination platform should be established.In terms of fostering sports consumption,it is necessary to promote the supply-side reform of the sports industry,enhance the fun of sports content and secure the property rights of head brand innovation,build a legal channel for embodying the government’s intention in the development of the sports industry,improve the property rights system that integrates and transforms the public and private sectors,and strengthen the protection of intangible assets in sports.
