摘　　要：《中华人民共和国民营经济促进法(草案征求意见稿)》针对实践中影响民营经济发展的障碍,系统、全面地规定了促进民营经济发展的制度规则体系。该《草案》贯彻平等保护原则,其最大的亮点在于落实“两个毫不动摇”,坚持平等保护的法律原则,全面强化对民营经济组织及其经营者财产权利、人身权利和经营自主权的保护。为落实上述理念,该《草案》深化对民营经济组织及其经营者人身和财产权益的行政保障和司法保障。该《草案》在总结实践经验的基础上,为保障民营经济组织及其经营者合法权益,对依法行政和公正司法作出了规范。为强化对民营经济组织及其经营者经营自主权的保障,该《草案》规定了负面清单管理模式,为民营经济组织依法自主经营提供了基本保障。同时,该《草案》还确立了公平竞争审查制度,以保障负面清单管理模式的落实。The Law of the People's Republic of China on the Promotion of Private Economy(Draft for comments)systematically and comprehensively stipulates the system of rules to promote the development of private economy in view of the obstacles affecting the development of private economy in practice.The draft implements the principle of equal protection.Its biggest highlight is to implement the“two unwavering”,adhere to the legal principle of equal protection,and comprehensively strengthen the protection of property rights,personal rights and management autonomy of private economic organizations and their operators.In order to implement the above ideas,the draft deepens the administrative and judicial protection of the personal and property rights and interests of private economic organizations and their operators.On the basis of summing up practical experience,the draft regulates administration according to law and fair justice in order to protect the legitimate rights and interests of private economic organizations and their operators.In order to strengthen the guarantee of the operation autonomy of private economic organizations and their operators,the draft stipulates the negative list management mode,which provides the basic guarantee for the independent operation of private economic organizations according to law.At the same time,the draft also established a fair competition review system to ensure the implementation of the negative list management mode.
